How effective has human rights legislation been in securing protection of the environment? (context of UK)

All essays must have a clear legal framework and legal underpinning and as such should include, where appropriate, reference to legislation and / or case law and authoritative legal texts and journal articles. Essays may also include, where appropriate, reference to environmental principles, policies

and practice in addition to key environmental issues.

The paper should have an introduction, a methodological explanation and have properly worked up conclusions and recommendations if appropriate. The paper must be word-processed and be correctly referenced.

In addition the paper should:

” explain the background and emergence of the topic as an environmental law / policy issue;

” discuss the major elements and themes involved;

” evaluate the contribution that environmental law and policy can make to resolving or taking into account the issues involved;

analyse the constraints on reaching a solution to the issue;

” suggest future ways forward.

Assessment criteria

The paper will be assessed on the following:

” structure: well set out and properly constructed argument and themes;

” content: the paper must contain a clear and concise account of the chosen topic and demonstrate good knowledge of the issues, with appropriate reading;

” critical analysis: the paper must evaluate the chosen topic in a critical way and show evidence of analytical content and clarity in legal argument;

” presentation: a good standard of communication in a clear and readable form;

” references: all sources must be clearly referenced with a list of references at the end of the paper.

Referencing to cases is a must..
