Istinction between Crimes against Humanity and Cultural Genocide
The definition of genocide can be recognised in Article II of the Genocide Convention and Article 6 of the Rome Statute. Although there was the cultural dimension was envisaged by Lemkin, it was excluded by the drafters. Article 7 of the Rome Statute defines Crimes against Humanity. Both international core crimes are applicable to offences committed in peace and wortime.
